Age Requirement (18+)

You must be at least 18 years old to use TaoFlux.

By creating an account or using our service, you confirm that you are at least 18 years of age. We do not provide services to minors. If we discover that a user is under 18, their account will be immediately terminated.

1. Service Description

TaoFlux is an AI-powered photo generation platform (Software as a Service). We provide AI-generated portrait photos based on images you upload. Key points:

Results are generated by AI and may vary in quality and accuracy
We do not guarantee specific outcomes or exact likeness
The service is provided "as-is" without warranties of fitness for any particular purpose
Processing times may vary based on demand and system capacity

2. User Responsibilities & Content Rules

You are responsible for:

Ensuring you have legal rights to all photos you upload
Obtaining consent from all individuals depicted in your photos
Complying with all applicable laws and regulations in your jurisdiction
Maintaining the security of your account credentials

Strictly Prohibited Content:

Any sexual, explicit, or nude content involving minors
Non-consensual intimate imagery ("revenge porn")
Stolen identity photos or celebrity impersonation for fraud
Violent, hateful, or discriminatory content
Copyrighted or trademarked material without permission
Content that violates any applicable laws

Violation = immediate termination + permanent ban + law enforcement notification.

3. Intellectual Property & Ownership

Your Rights

You retain ownership of photos you upload
You own generated images created from your photos
You may use generated images for personal or commercial purposes
No additional licensing fees for commercial use

License to TaoFlux

Process your photos to generate images
Display generated images in your account
Use anonymized samples for marketing (opt-out available)

This license is non-exclusive, royalty-free, and terminates when you delete your account.

Important: You are solely responsible for how you use generated images. If you commercialize or republish them, you assume all legal responsibility for copyright and likeness claims.

4. AI Training & Data Usage

We DO NOT use your photos or generated images to train our AI models.

Our AI models (Flux, Gemini) are pre-trained by their providers (Replicate, Google)
Your data is used only for the specific generation task you request
Anonymized prompts may be stored for 7 days for abuse detection
Any future opt-in training programs will require explicit consent

5. Subscription, Billing & Refunds

Subscription Terms

Subscriptions renew automatically (monthly or annually)
You can cancel anytime before the next billing cycle
Cancellation takes effect at the end of current billing period
We reserve the right to adjust pricing with 30 days' notice

How to Cancel Your Subscription

Go to Account Settings → Subscription
Click "Cancel Subscription"
Confirm cancellation (you'll keep access until period ends)
You'll receive a confirmation email

Tip: Cancel at least 24 hours before your next billing date to avoid charges.

Refund Policy

Eligible for Refund:

Duplicate/accidental charges (within 14 days)
Service unavailable >24 consecutive hours
Billing errors on our end
Technical issues preventing any usage

NOT Eligible for Refund:

Already-used credits or completed generations
Change of mind after purchase
Dissatisfaction with AI output quality
Account termination for policy violation

EU Customers: Right of Withdrawal

Under EU consumer law, you have a 14-day cooling-off period for digital services. However, by using the service (generating images) within this period, you acknowledge that you have waived this right. If you haven't used any generation credits, you may request a full refund within 14 days of purchase.

To request a refund: billing@taoapex.com Email billing@taoapex.com with your account email and reason. We respond within 3 business days.

6. Limitation of Liability

We are not liable for AI generation failures, quality issues, or model limitations
You are solely responsible for how you use generated images
We do not warrant uninterrupted or error-free service
If you commercialize generated images, you assume all legal responsibility
Maximum liability: Maximum liability: The amount you paid us in the 12 months preceding any claim

7. Service Changes & Termination

We may modify, suspend, or discontinue features with reasonable notice
We may terminate accounts violating these Terms immediately without notice
Upon termination, you have 30 days to download your generated images
We are not liable for losses resulting from service changes or termination

8. Governing Law & Dispute Resolution

These Terms are governed by the laws of Singapore, without regard to conflict of law principles.

Dispute Resolution Process:

Informal Resolution (Required First Step):
Contact us at legal@taoapex.com. We'll attempt to resolve the issue within 30 days.
Mediation:
If informal resolution fails, both parties agree to attempt mediation before arbitration.
Binding Arbitration:
Unresolved disputes shall be settled by binding arbitration in Singapore, conducted in English under the rules of the Singapore International Arbitration Centre (SIAC).

Note: Nothing in these Terms prevents you from bringing issues to the attention of regulatory agencies or seeking injunctive relief for IP infringement.

9. Changes to These Terms

We may update these Terms from time to time. For material changes, we will notify you via email and/or a prominent notice on our website at least 14 days before they take effect. Continued use after changes take effect constitutes acceptance of the new Terms.
